Terms of Service

The Madeira Kids platform (madeirakids.com) is operated by:

In these Terms of Service, 'Madeira Kids', 'we', 'us' and 'our' refers to Glaciergadget - Unipessoal Lda. 'User', 'you' and 'your' refers to any person who accesses or uses the platform.

Madeira Kids is a discovery and curation platform for family-friendly experiences, places, events and businesses on the island of Madeira. The service includes:

• check_circleA directory of family-friendly places, activities and businesses.
• check_circleAn events calendar for families with children.
• check_circleEditorial content — articles, guides and tips written by the Madeira Kids team and approved contributors.
• check_circleNewsletter and communications for subscribers.
• check_circleA partnership programme for businesses and bloggers, described in our Partner Terms.
• check_circleDigital products and services purchasable through the platform.

Madeira Kids reserves the right to modify, expand or discontinue any feature of the service with reasonable prior notice.

Account registration is required to access certain platform features, including saving favourites, leaving reviews or subscribing to partnership plans.

By creating an account, you agree to provide true, accurate and up-to-date information. You are responsible for keeping your login credentials confidential and for all activity carried out under your account.

Each user may create only one account. Duplicate or fraudulently created accounts will be deleted. If you suspect unauthorised access to your account, contact us immediately at hello@madeirakids.com.

Madeira Kids may offer digital products (guides, resources, access to premium features) for purchase through the platform.

• check_circleImmediate delivery: upon payment confirmation, you receive immediate access to the purchased digital product. There is no physical shipment.
• check_circleYou are responsible for ensuring that the email address and details provided at the time of purchase are correct. Madeira Kids is not liable for delivery failures resulting from incorrect information provided by the user.
• check_circleDigital products are licensed for the purchaser's personal use. Unless expressly stated otherwise, reproduction, distribution or resale of the product is not permitted.
• check_circleIf a technical issue prevents access to a purchased product, contact hello@madeirakids.com within 7 days of purchase for assistance.

Payments on the Madeira Kids platform are processed by Stripe, Inc., a PCI-DSS certified payment service provider. Madeira Kids does not store credit or debit card data.

All prices are displayed in Euros (€). Applicable VAT will be added at checkout in accordance with Portuguese tax legislation in force.

By completing a purchase, you agree to Stripe's terms of service (stripe.com/legal/ssa). For disputes relating to a transaction processed by Stripe, please contact Stripe directly or your card-issuing bank.

• check_circleMonthly or annual subscriptions: renew automatically at the end of each period. You may cancel at any time in your account settings or by contacting hello@madeirakids.com.
• check_circleOne-time purchases: payment is charged at the moment the purchase is confirmed.
• check_circlePayment failures: if a payment fails, we will attempt to process it again and notify you by email. Paid features may be suspended until the payment is resolved.

Our refund policy is defined in accordance with Decree-Law No. 24/2014 (Portuguese legislation on distance contracts) and Decree-Law No. 84/2021 (sale of goods and supply of digital content).

• check_circleDigital products with immediate access: by completing the purchase, you expressly authorise the supply of the digital content to begin before the end of the 14-day withdrawal period, thereby acknowledging that you waive your right of withdrawal, as provided for in Art. 17(1)(m) of DL 24/2014.
• check_circleSubscriptions: you may cancel a subscription at any time. Cancellation takes effect at the end of the current billing period — partial refunds for the remaining period are not issued, except in the case of an error attributable to Madeira Kids.
• check_circleFailure to deliver by Madeira Kids: if we are unable to deliver the purchased product or service due to reasons attributable to Madeira Kids, you are entitled to a full refund of the amount paid.
• check_circleRefund requests must be sent to hello@madeirakids.com with your transaction reference. They will be assessed individually within 10 business days.

By using the Madeira Kids platform, you agree not to:

• check_circlePost content that is false, misleading, defamatory, discriminatory, illegal or that infringes the rights of third parties.
• check_circleAttempt to gain unauthorised access to platform systems, accounts or data.
• check_circleUse automated mechanisms (bots, scrapers) to collect data from the platform without prior written authorisation.
• check_circlePost or transmit malicious code (viruses, malware) or any content that could damage the platform or its users.
• check_circleImpersonate another person or entity.
• check_circleUse the platform for spam or to contact users in an unsolicited manner.

Violation of these rules may result in the immediate suspension or deletion of your account, without entitlement to a refund of amounts already paid.

All editorial content on the platform — text, original photographs, design, logos, code and other elements created by Madeira Kids — is the property of Glaciergadget - Unipessoal Lda and is protected by applicable intellectual property law.

By submitting content to the platform (photos, descriptions, reviews), you warrant that you hold the necessary rights and grant Madeira Kids a non-exclusive, royalty-free, worldwide licence to display and distribute that content in the context of operating the platform.

Reproduction, distribution or adaptation of platform content without prior written authorisation from Madeira Kids is not permitted.

Madeira Kids endeavours to keep information published on the platform accurate and up to date, but does not guarantee the accuracy, completeness or currency of all content, in particular information provided by business partners or third parties.

To the maximum extent permitted by applicable law, Madeira Kids is not liable for:

• check_circleIndirect, incidental or consequential damages resulting from use of the platform.
• check_circleTemporary interruptions or failures in access to the platform.
• check_circleDecisions made by the user based on information published on the platform.
• check_circleContent published by partners or third-party users.

Nothing in these Terms limits liability for fraud, gross negligence, death or personal injury, as provided for by Portuguese law.

These Terms of Service are governed by Portuguese law. In the event of a dispute arising out of or relating to these Terms, the parties agree to submit to the exclusive jurisdiction of the courts of Funchal, Madeira, without prejudice to consumers' right to bring proceedings before the courts of their habitual residence under European consumer protection legislation.

Consumers also have the right to use Alternative Dispute Resolution (ADR) mechanisms. For more information, visit the Portuguese Consumer Portal (consumidor.gov.pt) or the European Online Dispute Resolution platform (ec.europa.eu/consumers/odr).

We may revise these Terms of Service periodically. When we do, we will update the 'Last updated' date and notify registered users by email at least 14 days in advance of material changes.

Continued use of the platform after the effective date constitutes acceptance of the new Terms. If you do not agree with the changes, you should close your account before the effective date.
