1. Definitions
In these Partner Terms, "Madeira Kids", "we", "us", and "our" refers to the Madeira Kids Discovery Platform. "Partner", "you", and "your" refers to any individual or organisation that has registered for a paid or unpaid partnership with Madeira Kids, including business partners and approved blogger contributors.
"Listing" means any business profile, place entry, event announcement, service description, or promotional item published on the Platform by or on behalf of a Partner. "Content" means any text, images, logos, videos, offers, or other material submitted to the Platform by a Partner.
The "Platform" refers to the Madeira Kids website (madeirakids.com), its subpages, and any distribution channels operated by Madeira Kids including social media accounts and newsletters where partner content may appear.
2. Registration & Account
By completing the registration form and submitting it, you confirm that you have read, understood, and agree to these Partner Terms and our Content Guidelines. If you are registering on behalf of a business, you confirm that you have authority to bind that business.
You are responsible for the accuracy of all information provided at registration. We reserve the right to reject or suspend any partner account where the information provided is found to be false, misleading, or incomplete.
Each business may register only one account per distinct trading entity. Duplicate registrations are not permitted. Your account is non-transferable — you may not sell, assign, or transfer access to another individual or business without prior written consent from Madeira Kids.
You are responsible for maintaining the confidentiality of your account credentials. Any activity that occurs under your account is your responsibility. If you suspect unauthorised access, notify us immediately at hello@madeirakids.com.
3. Listing Standards & Accuracy
All Content you submit to the Platform must comply with our Content Guidelines at all times. In summary:
- arrow_forwardAll factual information — including opening hours, prices, contact details, location, and services offered — must be accurate at the time of submission and kept up to date throughout the term of your partnership.
- arrow_forwardPhotos must be your own or properly licensed for use on the Platform. You must not upload images that misrepresent the real experience a family will have.
- arrow_forwardYou must notify us promptly — and no later than 5 business days — of any material change to your business information: changes to opening hours or prices, seasonal closures, temporary suspension of services, or permanent closure.
- arrow_forwardEvent listings must correspond to real, confirmed events with accurate dates and details. Speculative, recurring placeholder, or past events must be removed or updated.
- arrow_forwardService and pricing descriptions must reflect real, current offerings. Promotional pricing must correspond to active offers.
Failure to maintain accurate listings is the most common reason for partner suspension. We enforce this strictly because families make real decisions based on the information we publish.
4. Fees, Billing & Cancellation
Paid partnerships are billed monthly or annually depending on the plan selected at registration. All prices are in Euros (€) and exclude any applicable VAT. VAT is added at checkout where required by Portuguese tax law.
Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel your subscription at any time from your account settings or by contacting hello@madeirakids.com. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for time remaining in the period.
We reserve the right to change our pricing with a minimum of 30 days' notice. Price changes will be communicated by email to the address registered on your account. Your continued use of paid features after the effective date of a price change constitutes acceptance of the new pricing.
If a payment fails, we will retry the charge and notify you. Accounts with outstanding payments may have their listings unpublished until the balance is settled. Accounts with unpaid balances for more than 30 days may be terminated.
Free plan accounts are not subject to billing but remain subject to all other terms in this document.
5. Intellectual Property
You retain ownership of all Content you submit to the Platform. By submitting Content, you grant Madeira Kids a non-exclusive, royalty-free, worldwide licence to display, reproduce, adapt, and distribute that Content for the purpose of operating and promoting the Platform — including on social media channels, in newsletters, and in editorial features related to your listing.
This licence ends when your listing is removed from the Platform, except for Content that has already been published in an article, newsletter issue, or social media post — which we may retain in its original published form for archival purposes.
You confirm that you have all necessary rights to the Content you submit, and that its use by Madeira Kids as described above does not infringe any third-party intellectual property rights.
Madeira Kids retains all rights to the Platform itself, its design, editorial framework, brand assets, and independently produced editorial content. Partners may not reproduce, scrape, or frame Platform content without prior written consent.
6. Partner Conduct
As a partner, you agree to conduct yourself and your interactions with Madeira Kids, our team, and our users with honesty and good faith. Specifically, you agree not to:
- arrow_forwardAttempt to manipulate your listing's position or visibility through artificial means, including by creating fake reviews or coordinating mass engagement.
- arrow_forwardContact users who have engaged with your listing through Madeira Kids for any purpose other than responding to a genuine enquiry or booking.
- arrow_forwardUse the Partner badge, Madeira Kids logo, or any Madeira Kids brand assets in any way not expressly authorised in writing.
- arrow_forwardDisparage, defame, or make misleading statements about competing businesses or about Madeira Kids itself.
- arrow_forwardUse your account to promote content that is harmful, discriminatory, illegal, or that would violate our Content Guidelines.
- arrow_forwardCircumvent any technical measures in place on the Platform.
7. Additional Terms for Blogger Partners
Blogger and creator partners who contribute editorial content to Madeira Kids are subject to all terms in this document plus the following:
All articles, guides, and reviews you submit must be original work. You may not submit content that has been published elsewhere, generated entirely by AI without meaningful human editorial input, or that reproduces substantial portions of other published sources without attribution.
You must disclose any material connection to a business you write about — including complimentary visits, affiliate relationships, or paid arrangements — using the disclosure language provided by Madeira Kids. Failure to disclose is grounds for immediate removal of the content and termination of the partnership.
Madeira Kids may edit submitted content for clarity, accuracy, length, or tone. We will seek your approval for substantive changes. We reserve the right to decline publication of any submission without obligation to provide reasons.
Articles published on the Platform remain accessible at their original URL for a minimum of 12 months. If you request removal of your content, we will review on a case-by-case basis — we cannot guarantee removal of content that has been indexed or shared.
You are responsible for ensuring that any claims you make about safety, accessibility, or suitability of an experience for children are accurate and based on direct, recent experience. Madeira Kids is not liable for any incident that occurs as a result of a family following advice in your published content.
8. Suspension & Termination
We may suspend or terminate a partner account at any time if:
- arrow_forwardYou breach any provision of these Partner Terms or our Content Guidelines.
- arrow_forwardWe receive credible reports that your business is operating in a manner that is harmful to families or inconsistent with the values of Madeira Kids.
- arrow_forwardYour listing repeatedly contains inaccurate information despite being notified.
- arrow_forwardYour account has an outstanding unpaid balance for more than 30 days.
- arrow_forwardWe determine, at our sole discretion, that continued association with your business would be detrimental to the reputation or safety of the Platform.
Where possible, we will give you prior notice and an opportunity to resolve the issue before suspending your account. In cases involving harm to users, deception, or legal risk, we may act without prior notice.
9. Limitation of Liability
Madeira Kids provides the Platform and partnership services on an 'as available' basis. We do not guarantee uninterrupted availability of the Platform, specific levels of traffic or visibility for any listing, or any particular commercial outcome from your partnership.
To the maximum extent permitted by applicable law, Madeira Kids is not liable for any indirect, incidental, or consequential loss arising from your use of, or reliance on, the Platform or any content published on it — including loss of revenue, loss of bookings, or reputational harm arising from a listing error.
Our total liability to any Partner under these terms, in any 12-month period, is limited to the total fees paid by that Partner in the same period.
Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence.
10. Governing Law & Disputes
These Partner Terms are governed by the laws of Portugal. Any dispute arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Funchal, Madeira.
Before initiating any formal proceedings, both parties agree to attempt to resolve disputes in good faith through direct negotiation. If a dispute cannot be resolved within 30 days of written notice, either party may pursue formal resolution.
If any provision of these terms is found to be unenforceable, the remaining provisions remain in full force.
11. Changes to These Terms
We may update these Partner Terms from time to time. When we do, we will update the 'Last updated' date at the top of this page and notify active partners by email with a minimum of 14 days' notice before changes take effect.
Your continued use of your partner account after the effective date of any changes constitutes your acceptance of the updated terms. If you do not agree to the updated terms, you may cancel your account before the effective date.
